Terms of use

These terms are a contract between you and the publisher of KWAH. By creating an account or using KWAH, you accept them. If you don’t agree, don’t use KWAH.

This is a translation. If the two versions ever differ, the French version prevails.

1. Who KWAH is

KWAH is an app published by Julien Thurnherr, Chemin du Port 3a, 1297 Founex, Switzerland (“KWAH”). Contact: hello@kwah.ch. What KWAH does with your data is explained in the privacy policy.

2. Minimum age

KWAH is for people aged 16 and over. By creating an account, you confirm you are. If you are under 18, you confirm that your parents or legal guardian agree.

3. Your account

• The information you give is accurate. One account per person, never in someone else’s name.
• Your account is personal: you don’t lend it or sell it.
• You protect access to your account and are responsible for what happens on it. If you think someone else is using it, email us right away.
• You can delete your account at any time: Profile → Settings → Delete Account. See how.

4. The service

• KWAH is currently free. KWAH may evolve the app, add, change, limit or remove features, and interrupt it for maintenance, without this giving rise to any compensation.
• If paid features are offered one day, their price and terms will be shown before any purchase. Purchases go through Apple and refunds follow Apple’s rules.
• If KWAH ever offers restaurant deals or sponsored content, they will be clearly labelled as such.

5. Your content

• Your KWAHs, photos, notes, comments and messages remain yours.
• You give KWAH a free, non-exclusive, worldwide permission to host them, copy them to its servers and backups, adapt their format (size, compression) and show them to the people you chose (Private, Friends or Public). This permission only serves to run KWAH and ends when you delete the content, subject to technical backups that are deleted automatically (7 days at most).
• KWAH doesn’t sell your content or use it for advertising. To feature one of your KWAHs in any communication, KWAH will ask for your consent first.
• You confirm you have the right to post what you post: your own photos, and photos of people who agree to appear in them.
• You alone are responsible for your content. KWAH has no obligation to monitor what is posted.

6. Honest reviews

• A KWAH is your personal opinion about a real meal. KWAH does not adopt it as its own.
• Stay fair and factual: no false or defamatory accusations against a restaurant or a person.
• A review that was paid for, or given in exchange for a benefit, must say so clearly.

7. What’s not allowed

KWAH has zero tolerance for abusive content or behaviour. In particular, the following are not allowed:

• spam, scams and hidden advertising;
• harassment, threats, intimidation;
• hateful, violent, sexual or illegal content, or content that infringes someone’s rights (copyright, image, privacy);
• impersonating someone, or creating an account to get around a block or suspension;
• fake reviews and undisclosed paid reviews;
• posting private information about someone without their consent;
• using KWAH for commercial purposes without KWAH’s permission;
• mass-copying content or restaurant pages, using bots, decompiling the app, overloading it, getting around its protections or accessing what isn’t yours;
• spreading viruses or any harmful code.

8. Moderation

• You can report a KWAH, a comment or a profile, and block someone. The reported person never learns who reported them.
• If KWAH reasonably believes a rule has been broken or someone is at risk, KWAH may, at its discretion and without compensation: hide or remove content, limit features, suspend or delete an account. For serious abuse, without prior warning.
• Every decision is logged. You can contest it at hello@kwah.ch.
• KWAH may share information with authorities when required by law.

9. Are you a restaurant or an affected third party?

Does some content seem illegal, defamatory or infringe your rights? Email hello@kwah.ch with a link to or description of the content and the reason. KWAH reviews it promptly and removes it if it is unlawful.

10. Restaurant pages

Restaurant pages (address, opening hours, category, description) are completed from public sources, members’ suggestions and automated tools. They are indicative and may contain mistakes: check with the restaurant before you go. An image marked “Illustration” doesn’t show the restaurant itself. KWAH is not affiliated with, or paid by, any restaurant.

11. What belongs to KWAH

The app, its code, its design, the KWAH name and logo, Pomo, the companions, the illustrations and the restaurant database belong to KWAH. You receive a personal, free, non-exclusive and non-transferable right to use the app for your private use. Any other use requires KWAH’s written permission.

12. Your ideas

If you send ideas or feedback, KWAH may use them freely to improve the app, without obligation or payment.

13. Other companies’ services

KWAH relies on services from other companies (Apple, Google, Apple Maps…). Their own terms apply when you use them, and KWAH is not responsible for how they work.

14. No warranty

KWAH is a free and still young service, provided as is and as available. To the extent permitted by law, KWAH does not guarantee that the app will always be available or error-free, or that information is accurate or complete. Keep a copy of your important photos: KWAH is not a backup service.

15. KWAH’s liability

To the extent permitted by Swiss law, KWAH’s liability is excluded, in particular for: content posted by members; decisions made relying on a review or a restaurant page; interruptions, errors or data loss; indirect damage; other companies’ services; unauthorised access despite reasonable security measures.

This exclusion does not apply to intentional misconduct or gross negligence, or where mandatory law forbids it.

16. Your liability

If someone makes a claim against KWAH because of your content or because you culpably broke these terms, you bear the resulting damage to KWAH, including reasonable legal fees, within the limits of the law.

17. Ending

• You can stop at any time by deleting your account.
• KWAH may close your account if you break these terms, immediately for serious abuse.
• KWAH may shut down the app. If so, you’ll be told at least 30 days in advance whenever possible, so you can retrieve your data.
• Sections 5 (for backups), 11, 14, 15, 16 and 20 continue to apply after the end.

18. Changes

KWAH may change these terms. If a change is significant, you’ll be told in the app before it applies. If you keep using KWAH afterwards, you accept the new version; otherwise, you can delete your account.

19. Apple

If you downloaded KWAH from the App Store:

• these terms are concluded between you and KWAH, not with Apple. KWAH, not Apple, is responsible for the app and its content;
• Apple has no obligation to provide support or maintenance for the app;
• Apple is not responsible for claims relating to the app (how it works, legal compliance, third-party rights);
• you confirm you are not located in a country under a US embargo and are not on a list of sanctioned persons;
• Apple and its subsidiaries are third-party beneficiaries of these terms and may enforce them against you.

20. General provisions

• If a clause is invalid, the rest still applies; the clause is replaced by the closest valid rule.
• If KWAH doesn’t enforce a right straight away, it does not waive it.
• KWAH may transfer this contract to a company that takes over the app, for example a company set up by Julien Thurnherr. You will be informed.
• If the versions ever differ, the French version prevails.

21. Governing law and courts

These terms are governed by Swiss law, excluding conflict-of-law rules and the Vienna Convention. The courts of the district of Nyon (Vaud) have jurisdiction, subject to mandatory rules that let consumers bring proceedings where they live.
